1. About These Terms
These Terms & Conditions govern your use of Preloved platform ("the platform"). By creating an account or using the platform, you agree to these terms. If you do not agree, please do not use the platform.

2. Who Can Use The Platform
You must be 18 years of age or older to create an account and use the platform. The platform is designed for parents and family members buying and selling preloved kids' and family items.
By creating an account you confirm that:
- You are 18 years or older
- The information you provide is accurate and truthful
- You will use the platform in accordance with these terms
3. What You Can Sell
Preloved is for preloved kids' and family items only. This includes:
- Children's clothing (newborn to teen)
- Toys and games
- Baby gear (prams, car seats, bouncers, high chairs etc.)
- Nursery furniture and equipment
- Books and educational materials
- Maternity clothing
You may not list:
- Items that are not kids' or family related
- Recalled or unsafe products
- Counterfeit or fake branded items
- Adult items of any kind
- Weapons or dangerous items
- Illegal items of any kind
- Items you do not own or have the right to sell
We reserve the right to remove any listing that does not comply with these guidelines without notice.
4. Seller Responsibilities
As a seller on Preloved you agree to:
- Accurately describe every item you list, including its condition
- Use photographs that genuinely represent the item
- Disclose any faults, damage or wear honestly
- Ship items promptly once a sale is confirmed
- Use tracked postage for all shipments
- Communicate with buyers through the in-app messaging system only
- Not conduct transactions outside of the platform
Tracked postage is required for all sales. Sellers who cannot provide proof of tracked shipment in the event of a dispute may not be eligible for seller protection.
5. Buyer Responsibilities
As a buyer on Preloved you agree to:
- Complete purchases honestly and in good faith
- Pay promptly when you commit to a purchase
- Communicate with sellers through the in-app messaging system only
- Not make false claims about items not received or not as described
- Not conduct transactions outside of the platform
6. Payments
All payments on the platform are processed securely through Stripe. By making a purchase you agree to Stripe's terms of service.
Funds are held briefly after confirmed delivery before being released to the seller. This provides a short window for buyers to raise any issues.
7. Fees
During our launch period, listing on Preloved is free.
We will introduce a transaction fee on sales in the future. We will give users a minimum of 6 weeks notice before any fee is introduced. Users who joined during our founding member period will be notified of their status separately.
8. Disputes
If something goes wrong with a transaction, we ask that buyers and sellers first attempt to resolve the issue directly through in-app messaging.
If a resolution cannot be reached, you can contact us at hello@thelittlemarketplace.com.au within 7 days of the issue arising. We will review the evidence provided by both parties and make a decision in good faith.
We cover the following disputes:
- Item not received (where seller cannot provide tracked shipping proof)
- Item significantly not as described (wrong item, major undisclosed damage, counterfeit)
- Item damaged in transit
We do not cover:
- Change of mind
- Item does not fit (sizing)
- Buyer's remorse
- Transactions conducted outside of the platform
Our decision on disputes is final. We are not liable for losses beyond the value of the transaction in dispute.
9. Prohibited Conduct
You must not:
- Use the platform for any unlawful purpose
- Harass, threaten or abuse other users
- Post false or misleading listings
- Attempt to conduct transactions outside the platform to avoid fees or protections
- Use another person's account
- Attempt to hack, disrupt or damage the platform
- Scrape or collect data from the platform without permission
We reserve the right to suspend or permanently ban any account that violates these terms.
10. Our Role
Preloved is a platform that facilitates transactions between buyers and sellers. We are not a party to the sale itself. The contract for the sale of goods is between the buyer and seller.
We do not guarantee the quality, safety or legality of items listed on the platform. We are not responsible for any loss arising from transactions between users.
11. Limitation of Liability
To the maximum extent permitted by Australian law, Preloved is not liable for:
- Loss or damage arising from transactions between users
- Loss of data
- Indirect or consequential loss of any kind
Nothing in these terms excludes any rights you have under the Australian Consumer Law.
12. Intellectual Property
All content on Preloved platform — including the name, logo, design and copy — is owned by Preloved. You may not reproduce or use our branding without written permission.
When you post content on the platform (listings, photos, messages), you retain ownership of that content but grant us a licence to display it on the platform.
13. Changes to These Terms
We may update these terms from time to time. We will notify you of significant changes by email or via a notice on the platform. Continued use of the platform after changes constitutes acceptance of the updated terms.
14. Governing Law
These terms are governed by the laws of New South Wales, Australia. Any disputes arising from these terms will be subject to the jurisdiction of the courts of New South Wales.
